ADDITIONAL INFORMATION for CONDOMINIUM SITES/UNITS

Phase 1
Please note the following Information regarding the Lone Oak of Red Mill Pond Development:

General Site Information

1. City Water and Sanitary Sewer Services
The water and sanitary sewer services are provided by the city
a. Applicable attachment or hook up fees will be charged in conjunction with building permits.
b. The city water and sanitary sewer services must be used per city regulations
c. Monthly fees will be billed individually from the city for these services
d. No HOA fees will be used for Individual site locations for these services
e. Common areas will be metered separately and billed to the HOA as required

2. Cable and Utility Networking Capability
The developer contracted specific companies to provide services to all Sites
a. Comcast, DP communications for Internet, Television and Phone capabilities
b. Consumers Power for natural gas and electric

3. Garbage/Refuse Pickup
The city will be responsible for garbage pickup and will supply appropriate containers.

4. Dam Maintenance District
As with all Red Mill Pond bordered properties, the subject property is in the Red Mill Pond Dam
Maintenance District. This district is governed by the Lenawee County Drain Commission.

5. Lone Oak of Red Mill Pond Community (A Private Development Umbrella Corp)
The entire Lone Oak of Red Mill Pond Community is made up of the present Phase 1
development as well as Annexable Land stated in the Lone Oak of Red Mill Pond Community
documents. This annexable land (Possibly Phase 2) can be added to the existing site
condominium, or a new neighborhood Association can be formed. It is up to the developer and
City (as applicable) to determine the best solution for all future annexable parcels.

6. Common Areas
The streets, street sidewalk and distinct location referenced as parks are common area owned
by Lone Oak of Red Mill Pond Community. The Community will be responsible for the
maintenance, and billing of features required for the Common areas and will invoice the
appropriate HOA for the costs of this service. At the onset, the Lone Oak of Red Mill Pond
Condominium is the sole recipient for billings, with the Developer retaining the ownership of
unsold units as applicable.

7. Lone Oak of Red Mill Pond Condominium Association
The Phase 1 Project is a site condominium, and recorded association master deed and by laws
are applicable. There are 2 distinct areas within the site Condominium called Estates and
Condominium Villas.
a. Prior to the first amendment, the Lone Oak of Red Mill Pond is made up of 65 sites. (49 Estates Sites and 16 Condominium villa sites)
b. Building and Use Restrictions apply
c. HOA assessments will be used for, but not totally inclusive of the following items:
     • Insurances for any present or to be built Common structures
     • Liability and Fidelity insurance for its members
     • Street and street sidewalk maintenance (including clearing, salting, and periodic maintenance as required)
     • Storm Sewer maintenance within the boundaries of the development
     • Common area and entry lawn/landscape maintenance as required
     • Irrigation and herbicide requirements per the future landscape committee jurisdiction
     • The HOA will utilize electric and possible water meters at several locations which will be billed to the Association
     • Electrical requirements for all common areas (including underlighting)

8. Developer Comments and Intentions
When/If the new phase or phases are developed, the fees will be addressed based on new membership and requirements.
a. Street, sidewalks, and common areas are private as well as the owner sites.
b. The UNITS or sites are owned entirely by the buyer, with bylaws governing use of such
c. However, the developer reserves the right to allow entry to and through the common areas during the construction period.
d. It is the intent of the developer to allow pedestrian and vehicular traffic during the sales timeframe.
e. It is not the intent of the developer to allow NON-OWNER visitors the use of the park(s) as a gathering place or an entry/pickup point to and from the Red Mill Pond unless approved by the board or developer or its assigns.
f. The phased or annexable property is, or will be zoned appropriately in order to be annexed into the Community.
g. The OVERLOOK is a strategic location to view the pond and wildlife.
h. It is the intent of the developer during the construction and sales period to allow visitors periodic and timely use of this viewing location for picture taking, wildlife viewing and the like, so long as disruption to owner’s use is not inhibited.

9. Sidewalks
Phase 1 project is planned as fully curbed with sidewalks.
a. The sidewalks are designed at 6 feet in width and will be integrated with the curb.
b. All street sidewalks will be maintained by the Community HOA, including the clearing and salting as applicable and will be billed to the Lone Oak of red Mill Pond Condominium Association.

10. Non-Structure Maintenance Agreement
The ability for each site owner to purchase a maintenance agreement will be available by Villa and Estate owners. These will be estimated and defined in the spring of 2019 as applicable to each type of unit, location and size.
a. The Villa Areas will begin with a standard maintenance agreement in place.
Each owner has the ability to change their requirements and will be billed separately by the landscape company as applicable.
b. The fees will be addressed and dealt with per a specific renewable document and contract.
